Is the ESR issue historical or a current-year filing request?
The period involved determines whether an ESR matter needs attention under the former reporting regime.
| Situation | Relevant next step |
|---|---|
| Financial year ending after 31 December 2022 | ESR notifications and reports are no longer required for these years; review current corporate tax responsibilities separately. |
| An earlier notification or report is unresolved | Retrieve the original submission, activity records and correspondence to establish what remains outstanding for that period. |
| An authority asks for information or an amendment | Work from the complete request, its stated deadline and the evidence for the historical year concerned. |
| A previous penalty or decision is disputed | Review the decision and procedural history before assessing any available response; cancellation of later reporting does not erase earlier matters. |
This service concerns a defined historical issue, not a new annual ESR filing subscription.
The service addresses the particular historical issue; it does not offer annual ESR filings for periods where reporting has been discontinued.
Understand what changed
The Ministry of Finance announced the cancellation of ESR notification and reporting requirements for financial years ending after 31 December 2022. Its announcement also states that prior-year obligations, authority information or amendment requests and applicable penalties remain relevant. Read the MoF announcement. We use that distinction to determine whether there is a historical matter to address.
We do not offer a routine current-year ESR filing simply because a business previously submitted notifications. The starting questions are which year is involved, what activity was undertaken and whether an authority request or unresolved obligation exists. Corporate tax obligations are assessed separately and should not be treated as identical to the former ESR reporting process.
Reconstruct the relevant period accurately
Historical review requires evidence of what the entity actually did during the period, not only its present-day licence. We compare the previous notifications or reports with financial statements, contracts, income streams, governance records and other available evidence. The goal is to identify the facts supporting the historical position and any inconsistency that needs further investigation.
Where the original adviser is unavailable, we build an inventory of records held by the business and previous service providers. Missing evidence is labelled clearly. We do not create retrospective board minutes or other records that falsely suggest an action occurred; a reconstruction should distinguish contemporaneous documents from an explanation prepared later.
Prepare a focused response to the open matter
If an authority has requested information or an amendment, we work from the full request and correspondence history. The response plan identifies the questions, supporting documents, authorised signatory and applicable response date. We help prepare factual explanations and schedules that can be checked against the original records.
A notification issue, a substantive activity question and an imposed penalty are not the same engagement. We define the particular work and explain when separate technical analysis or a procedural challenge is needed. Authority decisions and the availability of a particular remedy are assessed on the case; no outcome or penalty cancellation is promised.
Leave a clear historical case file
The completed file records the periods reviewed, submissions or responses supported, evidence supplied and matters that remain open. This helps management, a future adviser or a transaction team understand what was resolved and what was not. We also separate the historical archive from current compliance responsibilities so an old ESR issue does not obscure the business's ongoing accounting and tax work.
Documents and records to prepare
Tick the records you already have. The final request depends on your entity, the period and the work agreed. Please do not send financial records through this website.

How the work starts
Confirm the historical issue
We establish the period, relevant authority correspondence and specific work that remains to be addressed.
Review and reconstruct
We compare the filed position with available contemporaneous evidence and identify gaps or inconsistencies.
Respond and document
We prepare agreed responses for approval, retain the submission record and explain any unresolved next steps.
What affects the scope and fee?
- Number of historical periods
- Availability of original records
- Nature of the authority request
- Technical assessment or procedural challenge required
We set out the deliverables, responsibilities and fee in the proposal. Work outside that scope is discussed before it is added.
Historical ESR support FAQs
Do businesses still file ESR reports for current financial years?
The MoF announcement cancelled notification and reporting for financial years ending after 31 December 2022. This service therefore addresses historical obligations and unresolved authority matters. We confirm the period before accepting work and do not present a current-year ESR filing as a routine requirement. See the official announcement.
Does the cancellation remove every earlier obligation or penalty?
No. The official announcement preserves responsibility for prior-year obligations and relevant authority requests and penalties. We review the specific case rather than assume an old matter has disappeared. Send the original correspondence and filing history so we can identify what remains open and the appropriate next assessment. Read MoF guidance.
Can you help if the previous adviser did not keep a complete file?
Yes. We first establish what records exist with the business, the former adviser and the relevant systems. We can organise and assess that evidence, but cannot recreate facts that cannot be supported. The review clearly distinguishes missing documents, reconstructed explanations and contemporaneous records before any response is prepared.
Will an old ESR conclusion determine our corporate tax treatment?
No. The regimes address different obligations and periods. Historical evidence may be relevant background, but a previous ESR filing does not establish the current corporate tax treatment of the business. We can coordinate the reviews while documenting separate questions, applicable rules and supporting records for each engagement.
Can you guarantee that a historical penalty will be cancelled?
No. We review the notice, supporting evidence and any available procedure before explaining the options. The authority decides the outcome, and timing or other conditions may affect what can be done. A penalty assessment or challenge is specifically scoped rather than implied by a general historical-records review.
